			<content:encoded><![CDATA[<p>The latest wrinkle in the ongoing battle over who can claim rights to “App Store” comes from independent mobile application download service GetJar, which says it will continue using the term.</p>
<p>Apple has been trying to gain exclusive rights to “App Store” for some time, with little success so far. After GetJar received a cease-and-desist letter from Apple asking it stop using the term “App Store,” the independent app service said it is refusing the request.</p>
<p>“Like Amazon and Microsoft, GetJar believes that the term ‘app store’ can be used by a variety of companies to market their app distribution services,” said Jason Koslofsky, an attorney with ArentFox LLP, Washington, DC.</p>
<p>“Apple is probably evaluating whether to bring suit against GetJar because GetJar declined to stop using the term,” he said.</p>
<p>Application marketplaces are integral to mobile, helping companies like Apple build out vibrant ecosystems for a smartphone.</p>
<p>Apple’s success with its iTunes App Store has been impressive and the company is looking to shore up its place in mobile applications.</p>
<p>Apple recently said that its App Store has surpassed 15 billion downloads. The number of downloads stood at 10 billion just six months earlier.</p>
<p>However, the broader app marketplace is growing as well, with more and more ways for consumers to discover and download apps becoming available.</p>
<p>If Apple decides it does need to own the rights to “App Store” to differentiate itself in the market given its strong standing, it may decide to give up the campaign to gain rights to the term.</p>
<p>GetJar has more than 50 million mobile application downloads per month and supports more than 1,800 phones.</p>
<p>GetJar addressed the situation with Apple in a company blog.</p>
<p>“GetJar won’t be subject to this kind of bullying,” the blog said. “We’re not going to ‘Cease &amp; Desist.’ We were here long before Steve &amp; Co.”</p>

			<content:encoded><![CDATA[<p>Broadband content, accessed using new media tools like wireless smartphones and Internet streams, continues to draw people and money away from traditional media outlets like radio and TV, according to an annual report on the Canadian communications industry.</p>
<p>Even so, broadcast revenues increased three per cent to $14.4 billion, mostly as a result of the specialty and pay television sector.</p>
<p>The Canadian Radio-Television and Telecommunications Commission (or CRTC) said in its report  that overall revenue reached $55.4 billion last year, up about two per cent.</p>
<p>The CRTC says the media and communications sector accounts for nearly five per cent of Canada&#8217;s total gross domestic product.</p>

<p>Apple&#8217;s haphazard app review process has led to a string of recent head-scratchers industry-wide.</p>
<p>Apple in early June censored an iPad graphic novel adaptation of Oscar Wilde&#8217;s &#8220;The Importance of Being Earnest,&#8221; and then reversed its decision.</p>
<p>Apple did the same with a comic adaptation of the James Joyce classic novel &#8220;Ulyssess&#8221; for the iPad, blocking the app for some graphic panels, and then undoing its decision after finding the product had artistic merit.</p>
<p>&#8220;Apple is in the power seat, serving as judge, jury and censor on the one hand, and on the other hand they&#8217;re hit-makers,&#8221; said Catherine Warren, president of Vancouver-based FanTrust Entertainment Strategies, an entertainment industry business developer.</p>
<p>&#8220;They&#8217;re in a position to prevent, delay or fast-track distribution. But if distribution is prevented or delayed, that hurts producers and fans who want the content,&#8221; Warren adds.</p>

<p>WATERLOO, ONTARIO/VANCOUVER, BC – January 20, 2009 – Metranome, the creators of mobile video applications for smartphones and portable devices such as the iPhone™ and iPod touch®, has retained FanTrust Entertainment Strategies for business development, community-building and to capture its share of the global mobile content sector worth $167 billion by 2013.</p>

To date, Apple® is estimated to have shipped more than 10 million 3G iPhones – and already about 30 percent of iPhone users watch mobile video on their devices. I would have to concur with <a href="http://marshallk.com/twitter-is-paying-my-rent">Marshall Kirkpatrick</a>. I also now use Twitter as a working tool, not just for 'status upates' (which I don't really do any more unless I can say something vaguely informative or funny). I use it to interrogate and interact with my work and social contacts. It's now one big ongoing conversation which can help me in my work, and especially in writing stories. I also was one of those who broke the story about Google buying <a href="http://jaiku.com">Jaiku</a>, and I got that because of seeing a Twitter post from a contact. As Marshall says:

People laugh at Twitter, and they can go ahead and laugh for all I care, but I'm here to tell you that it can be invaluable. Aside from the personal connectedness and relationship maintenance it's good for, let's be honest - it's paying my rent. (Thanks Twitter!) I don't mean they've hired me as a consultant, though I would love that, I mean Twitter is great for news discovery.
